Description

Rare original handwritten legal document dated September 7, 1811, from Bristol County, Massachusetts. This guardian selection certificate was executed before Justice of the Peace Charles Durfee and directed to the Honorable Hodijah Baylies, Esquire, Judge of Probate for Bristol County. The document certifies that Elizabeth Pearce formally chose Job Pearce as her legal guardian, in accordance with Massachusetts probate law of the period. Hodijah Baylies is a figure of significant historical note — a former aide-de-camp to General George Washington (from May 1782), veteran of Yorktown, member of the Society of the Cincinnati, and Judge of Probate for Bristol County from 1810 to 1834. This document falls within his active tenure on the bench. The Justice of the Peace signatory, Charles Durfee, was a prominent member of the well-known Durfee family of Bristol County/Tiverton, serving as Justice of the Peace and Town Clerk. Condition: Age-toned with fold lines and some foxing/staining to the reverse, consistent with over 200 years of age. The front text remains fully legible. Faint docket writing visible on the reverse. A wonderful piece of early American legal history with a direct connection to a soldier of the Revolution and aide to George Washington. Item is as shown in the photos.
